The Labour Court varied a public holiday pay decision on Top Security Limited’s appeal, requiring the company to pay Mr Brian Scully €21.12. The determination was dated 18 February 2022. The dispute concerned pay for a public holiday when Scully was not rostered to work. The Court found his normal working week was 48 hours, giving him an entitlement to 9.6 hours’ pay. As he received eight hours’ pay for 1 January 2020, the shortfall was 1.6 hours at €13.20 an hour. Scully withdrew his claim relating to 17 March 2020 because that date fell after he lodged his complaint.
