The Labour Court increased compensation for Mr Sergejs Pogodins to €350, varying the Rights Commissioner’s €152.10 award. The determination was dated 10 December 2012. Pogodins, who worked for C.J. Hurley Ltd in construction, said his annual and public holiday pay had been calculated using the Grade D rate instead of the Grade C rate he said he was entitled to. The company disputed his account of the work he performed and said it had paid the original award promptly. The Court said Pogodins should not bear the economic cost of pursuing his statutory entitlements through the legal process. It increased the compensation to cover that cost, while finding the company was not likely to breach the Act again.
