The Labour Court disallowed Nicolae Brinza’s appeal for a higher award and affirmed the €2,000 awarded by a Rights Commissioner. The determination was signed on 25 September 2009. Brinza appealed only the amount, after the Rights Commissioner upheld complaints about meal breaks and maximum working hours under the Organisation of Working Time Act 1997. Transteck Transportation Services Limited admitted it could not verify meal breaks and conceded that Brinza worked more than 48 hours a week on average. The Court found no basis to increase the compensation. It noted that Brinza had suffered no economic loss, the company had changed its recording procedures and its business had declined.
