The Labour Court overturned a €1,400 award to construction worker Ceslovas Grazevicius after his employer, Gerard Kearney, appealed. In a determination signed on 20 November 2009, it found no breach of four working-time provisions and dismissed Kearney’s appeal.
The complaints concerned breaks, maximum weekly hours, notice of additional hours and annual leave. Grazevicius said he worked more than 50 hours a week and received no holiday pay for 2008; Kearney disputed the hours and said the leave had been paid. The Court found that Grazevicius received 16 paid days of leave against nine accrued in the relevant period. It also found he did not exceed an average 48-hour week and that no Saturday work arose during the claim period.
