The Labour Court varied a €600 award to Dmitrius Anisimovs, retaining compensation for Schmidt Industries International Limited’s failure to give at least 24 hours’ notice of additional hours. The determination was signed on 3 October 2008, following Anisimovs’s appeal under the Organisation of Working Time Act 1997. The Court found no breach of the rules on breaks, accepting evidence that required breaks were provided. It also found no breach of the maximum weekly hours rule, calculating an average of 44.64 hours for the period it examined. Alleged breaches before 17 March 2007 were outside the six-month time limit and could not be considered; the merits of those earlier allegations were not decided. Anisimovs said he was told about overtime on the day it was required. The company said employees were notified the previous Friday, but produced no evidence to support that account.
