The Labour Court rejected Mary Keohane's appeal against a finding that her penalisation complaint against University College Cork was not well founded. The determination was signed on 28 November 2001.
Keohane alleged that she had been penalised after seeking holiday pay and not being offered a part-time Maths Methodology post. The Court found no connection between her holiday-pay activity and the appointment decision, noting that the professor had responded to her expressed reluctance to take the post. It also found that earlier incidents before the relevant provisions of the Act took effect could not ground the complaint.
The Labour Court affirmed the Rights Commissioner's decision and disallowed the appeal.
