WRC awards waitress €1,450 over unpaid holiday pay

The Workplace Relations Commission awarded Gabriela Concepcion Palomo Ramirez €1,450 over unpaid holiday and public holiday pay in a decision dated 26 May 2025. It also awarded her €2,000 after upholding her complaint that Leeson Catering Limited had not provided a proper written statement of her employment terms. The WRC found that 18.25 days’ pay in holiday and public holiday entitlement remained outstanding when her employment ended. Two payslips showed holiday payments totalling €678.49, but the money was not transferred to her, the adjudicator found. The Commission accepted her evidence that she had received only a starter form, not a proper statement of her terms. The respondent did not attend the hearing, although it had been notified, and provided no defence. Both complaints were found well founded.
