The Workplace Relations Commission found Kaspars Orlovs’s Sick Leave Act complaint against his former employer, Tiergaul Limited t/a Extraspace Solutions, not well founded. Adjudication Officer Michael McEntee dated the decision 7 May 2025. Orlovs said he was due statutory sick pay from the first day of absence after an alleged workplace accident in October 2024. The company said its Construction Industry Pension Scheme provided a more favourable overall benefit, despite a three-day waiting period. The adjudicator agreed that the scheme was more favourable overall, so the statutory sick leave rules did not apply.
