The Workplace Relations Commission ordered Smyth Kinsella Limited t/a Kustom Workwear Uniform And Safety Specialists to pay Louise O'Connor €10,025 after finding that workplace safety reporting played a part in her dismissal. The decision, dated 6 March 2025, upheld her civil complaint of penalisation under the Safety, Health & Welfare at Work Act 2005.
O'Connor alleged she was dismissed in retaliation for raising safety concerns after falls at work. The company denied penalisation and said she was let go during probation because of inadequate performance and poor attitude. Adjudication Officer Gaye Cunningham found that the recording of an 8 April 2024 accident was an operative reason for the dismissal, and that the complaint was well-founded.
