The Workplace Relations Commission ruled it had no jurisdiction to hear Damian Kirwan’s working-time complaint against An Garda Síochána because it was submitted outside the statutory time limit. The decision was dated 7 February 2025. Kirwan’s complaint concerned alleged loss of earnings during a suspension from duty from 4 May 2021 until his retirement on 9 December 2022. The WRC received it on 29 May 2024. Adjudication Officer Catherine Byrne found the complaint was outside both the usual six-month limit and the possible 12-month extension. The decision did not rule on the alleged working-time breach, and no monetary award was recorded.
