WRC upholds one employment terms complaint against Apple

The Workplace Relations Commission upheld one of Rachid El Achab’s four complaints against Apple Distribution International Ltd, finding that his written employment terms had not been updated when he became a Team Manager. The decision was dated 16 September 2024. Apple had since supplied revised terms, so the adjudicator made no further direction. The WRC found three other complaints not well founded. El Achab’s claims about Sunday premiums and overtime failed because he had already been compensated for Sunday work in the period considered and the law did not require overtime pay. The adjudicator found no reasonable cause to extend the time limit for earlier Sunday work. A complaint under road-transport working-time rules failed because those rules did not cover his role, and a further written-terms complaint failed because he had not specifically requested more secure and predictable working conditions.
