The WRC found it had no jurisdiction to hear Robert Talbot’s annual leave complaint against Twitter International Unlimited Company because he signed a severance agreement with informed consent. The decision is dated 16 November 2023; the merits were not decided. Talbot said the company had not paid €12,883 gross for his outstanding 2022 annual leave, as he said the severance agreement required. Twitter argued that the agreement settled employment claims, including claims under the Organisation of Working Time Act, and that the complaint was also out of time. The adjudication officer found that the agreement was intended as a full and final settlement, specifically covered the Organisation of Working Time Act and was signed with informed consent. Talbot said he understood the agreement, had time to consider it and had the opportunity to seek legal advice. The officer did not consider the time limit argument after finding the WRC had no jurisdiction.
