WRC says it lacks jurisdiction over former Mulligans worker’s breaks complaint

The Workplace Relations Commission said it had no jurisdiction to hear Yugesh Sow Sumroo’s complaint against Mulligans of Sandymount Limited about breaks and excessive working hours. The decision, dated 17 July 2024, said employment liabilities had transferred to Arundel Bar and Restaurant Limited under TUPE. The merits were not decided. Sumroo, a sous chef, said he had been denied breaks and made to work excessive hours while employed by Mulligans. The WRC found that liabilities under his employment contract passed to the new employer on the transfer date, so the complaint could not proceed against Mulligans.
