HSE plumber loses public holiday pay complaint

Mark Maloney’s complaint against the Health Service Executive over public holiday entitlement was found not well founded by the Workplace Relations Commission, in a decision dated 28 February 2024. Maloney said he was on call during the week of 31 October 2022 and should receive an extra day’s pay or annual leave. He accepted he had been paid for the holiday and received a €210 on-call allowance. The HSE said it had paid his entitlement and allowance. The adjudication officer found Maloney was not required to attend work that day and that his public holiday entitlement and on-call payment were appropriate, so no further entitlement was due.
