WRC awards €900 over missing break records

The Workplace Relations Commission awarded Daithi Oduibhir €900 after finding his employer breached its duty to keep records of breaks. The decision was dated 4 October 2023. Oduibhir said customers often interrupted breaks he took at his desk, and that he sometimes had no break when the owner was away. The respondent said he could take 45 minutes each day and chose to remain on the premises. The adjudicator said the evidence conflicted, but found the respondent had kept no break records. A separate complaint about written terms was found not well founded. The adjudicator said no written statement of terms had been provided in the first place, so there was no breach for failing to notify him of a change to it.
