The Workplace Relations Commission upheld two holiday-pay complaints by Kilkenny County Council worker Shane Leahy and made €500 compensation payable for each statutory breach. The decision was dated 23 April 2024.

Leahy argued that regular rostered overtime and other payments should count when his annual-leave and public-holiday pay were calculated. The council said overtime should be excluded under the relevant regulations. The adjudication officer found that regular rostered overtime and machine-washing payments counted for ordinary annual leave, but the on-site meal allowance did not. For public-holiday pay, overtime and the meal expense were excluded, while the historical machine-washing payment counted.

The parties were to use payroll records to agree retrospective adjustments for both claims, covering the six months before the complaints were lodged. The €500 compensation for each breach is separate from those adjustments.
