The Workplace Relations Commission found that the Irish Prison Service did not discriminate against senior psychologist Claire Moloney over its Covid-19 mask requirements at Cork Prison. The decision was dated 28 June 2023.
Moloney said wearing masks worsened her medical condition and that the service failed to accommodate her, harassed her and treated her differently. She had worked at Cork Prison from 2007 until resigning in 2021. She withdrew an original victimisation complaint at the start of proceedings.
The adjudicator found she had not established that she had a disability within the meaning of the law. He accepted evidence from the Prison Service’s chief medical officer that mask wearing would not worsen her condition or prevent her from wearing a mask. The WRC found no disability discrimination.
