The Workplace Relations Commission found Theresa Mcateer’s complaint against the Legal Aid Board was not well founded in a decision dated 30 May 2023. The case concerned 14 days of accrued annual leave that Mcateer said had been disallowed after changes to leave policies during the pandemic. The Board said a 15-month carry-over rule had been communicated and applied consistently. The adjudication officer found Mcateer had accrued leave while on sick leave and had an opportunity to take it within the applicable period. The officer found no breach of the Organisation of Working Time Act 1997, the Working Time Directive or the EU Charter. Mcateer withdrew three other complaints on 6 March 2023; the remaining complaint was heard on 8 March.
