The WRC recommended that a health care provider pay a manager for 225 hours of approved time in lieu at the rate applicable when the hours were worked, plus €1,000 compensation for the delay. The recommendation was dated 26 August 2022.
The worker had sought payment at her current, higher rate and challenged the filling of a higher-grade post from an extended recruitment panel. The provider had conceded payment for the time in lieu but said it should be calculated at the rate that applied when the hours were worked.
The WRC called the provider’s handling of the panel “sloppy practice” but did not recommend compensation for that part of the dispute. It recommended that the worker, through her union, accept that the matter was closed. The recommendation on time in lieu included payment for 225 hours at the rate applicable when worked, plus €1,000 for the extended delay in paying wages due.
