The Workplace Relations Commission found Stewart O’Reilly’s annual leave complaint against Lucan Disability Action Group Ldag was not well founded in a decision dated 29 September 2022. The dispute concerned 20 days of leave carried over from 2019 while O’Reilly was on long-term sick leave. O’Reilly disputed the organisation’s leave records, saying some days were rostered days off when he remained available for work. The organisation said its records showed he had received more leave than he was entitled to, including the carried-over days. The adjudication officer found the organisation had confirmed O’Reilly was entitled to the 20 days and that these were included in the 56 days of leave he received in 2020. The officer found no evidence of a breach of the Organisation of Working Time Act 1997.
