The Workplace Relations Commission awarded HSE nursing manager Mary T Keegan €2,500 after finding that her roster breached the legal requirement for 11 consecutive hours of daily rest once a week. The WRC decision was dated 5 April 2023. Keegan, who worked at Teach Ban, a psychiatric community residence in Dublin, said her roster left her with less than 11 hours between shifts one day each week. The HSE did not dispute the shift pattern and said it had been agreed with her union, with discussions under way about changing the hours. The WRC found the weekly rest breach was well founded and awarded €2,500. It rejected her separate argument that her workday breaks were too long, finding the law sets minimum break times, not maximums.
