The Workplace Relations Commission awarded David Barnes €897 after finding that Maguire Mechanical Ltd breached minimum-notice requirements. The decision was dated 3 January 2023. Barnes said he gave notice that he would leave at the end of the year but was told to finish that week and was not paid for his notice period. The company said he gave notice on 8 November and worked it out, and that he was paid. The WRC preferred Barnes’s account, finding he gave six weeks’ notice and the company ended his employment with one day’s notice before his final working day. With 15 months’ service, he was entitled to one week’s statutory notice. The award was compensation for his loss, equal to one week’s agreed pay.
