WRC finds worker’s dismissal dispute not well founded

The Workplace Relations Commission found a worker’s dismissal dispute not well founded in a recommendation dated 7 September 2023. The adjudicator found he had been told that passing probation depended on meeting sales targets and had not used the available appeal process. The worker said he was dismissed without fair procedures or warnings, and that the dismissal followed his health and safety concerns about an in-person meeting. The employer said his sales fell short during extended probation and cited conduct concerns as an additional reason. The adjudicator accepted that the worker was not warned again after the October review about sales targets or conduct affecting his retention. She nevertheless found the complaint not well founded because he had been on notice of the target condition and did not appeal his dismissal.
