The Workplace Relations Commission found four complaints by nurse Joanna Bazan against Children’s Health Ireland at Crumlin well founded over how the hospital calculated public holiday pay. It ordered €1,600 and €350 in compensation on two working-time complaints. The decision was dated 4 August 2023.

Bazan worked 11.5-hour shifts on Mondays, Thursdays and Fridays. The hospital calculated her public holiday entitlement by dividing her weekly hours by five, and required her to work back 4.6 hours when a holiday fell on a day she normally worked. It said its calculation complied with the relevant arrangements and regulations.

The adjudication officer found that Bazan’s normal daily hours, rather than an average, should determine holiday pay when she was normally required to work that day. The officer assessed actual losses of €586.08 and €146.52 and ordered compensation of €1,600 and €350, respectively, inclusive of those losses. The two Payment of Wages complaints were also upheld, but no additional compensation was ordered because they overlapped with the working-time complaints.
