The WRC recommended that a worker and a public service agree a process to consider her claim that she should have been its employee before 2014. The decision was dated 25 August 2022. The worker said she should be recognised as an employee from 1994 or 2000; the public service said the public voluntary hospital that paid her was her employer.
The worker worked in community mental health services operated by the public service, where the officer found she was integrated into its operations. The officer said deciding her employment status before 2014 could narrow the parties’ options and recommended further engagement, potentially involving an independent decision maker, to consider individual workers’ circumstances. Fast-accrual pension registration was outside the adjudication.
