The WRC recommended that a healthcare organisation regularise a senior manager's post at Grade VIII, effective from 1 January 2014, after an independent evaluation found his duties matched that grade. The recommendation was dated 11 May 2022.

The manager referred an industrial relations dispute after the organisation did not implement the evaluation outcome. He said the organisation and his union had agreed to the evaluation and accepted its finding. The organisation said it could not act without government department sanction, which had not been granted.

The adjudication officer found that both sides accepted the manager was carrying out duties above his grade and that Grade VIII was appropriate. She said the department's refusal to sanction implementation was unfair and unreasonable. She recommended that the post be regularised immediately and that the agreement limiting the arrangement to the two staff involved in the second job evaluation process be followed.
