The Workplace Relations Commission found Nua Healthcare Services Ltd was not required to pay Michael Flynn more than the one week’s notice he had already received. The decision was dated 9 May 2022. Flynn said he was entitled to two weeks’ notice after more than two years’ service. The company said it dismissed him for gross misconduct, which allowed it to terminate his employment without notice, and that the week’s pay was a gesture. The adjudication officer found the statutory exception for misconduct applied, so the company was not obliged to pay more than the week already paid. The minimum notice complaint was not well founded.
