The Workplace Relations Commission found three employment complaints by Gheorghe Daniel Marcu against Dangan Group not well founded in a decision dated 6 May 2022. Two other complaints were withdrawn. Marcu, a mobile supervisor, alleged that after transferring to Dangan Group he was not paid for 32 hours worked and two bank holidays, and that his duties changed. He also said he was penalised after objecting on health and safety grounds to under-racking work. The WRC found that under-racking was included in his job description and that the company could enforce the requirement and change how the task was done. It found the task change did not alter his contractual terms and the complaints he raised did not concern the health and safety matters covered by the relevant law. The complaints under transfer of undertakings regulations, the Terms of Employment (Information) Act and the Safety, Health and Welfare at Work Act were not well founded. The Payment of Wages Act complaint and an Industrial Relations Act complaint were withdrawn.
