The Workplace Relations Commission made no recommendation in favour of a driver seeking access to a transport company’s occupational injury sickness payment scheme. The recommendation was dated 15 May 2017. The company said the scheme allowed assessment by its medical specialist but not referral to a third party. The adjudicator noted the specialist assessed the driver and that two appeals against refusal of access were rejected. The driver had also accepted a Personal Injuries Assessment Board assessment, including its specified loss of earnings; the adjudicator said it was not her role to choose between differing medical assessments.
