The WRC ordered a retailer to restore a department-store supervisor’s key-holding and Sunday supervisory duties and pay her resulting lost earnings. The complaint was found well founded in a decision dated 15 September 2016, with payment due within six weeks.
The supervisor said the store withdrew those responsibilities after she was reinstated following an earlier Labour Court recommendation. The retailer said the duties were discretionary and it lacked confidence in her working unsupervised. The WRC found no evidence that she was unreliable in those functions and said their removal was inappropriate.
