WRC recommends 7.5% pay differential for sales assistant

Workplace Relations Commission ·

The WRC recommended that the retailer pay the sales assistant a 7.5% pay differential from 1 January 2012, after finding she was treated less favourably than colleagues doing the same work. The recommendation under the Industrial Relations Act 1969 was dated 22 November 2016. Mandate said she performed similar duties to colleagues who continued to receive the payment. The retailer argued she did not perform managerial duties and that the differential was temporary. The adjudicator found that the payment continued to be made to colleagues even after the retailer considered it an overpayment, and saw no good reason not to extend it to her.
