The Labour Court upheld Falkon Security Services’ appeal and set aside a Rights Commissioner’s £500 recommendation to a security guard who was dismissed after an alleged intoxication incident. The decision was signed on 27 November 1996. Both the company and the worker had appealed the recommendation. The company said the worker had been intoxicated at a security site and cited client complaints, warnings and its conduct policy. The worker disputed the company’s account and said he had not received the alleged warnings. The Court found that, given the seriousness of the incident and the nature of the work, the company was entitled to dismiss him.
