The Labour Court decided that a Rights Commissioner’s recommendation of £100 for each of two workers transferred to James Daly And Sons Limited’s Churchfield factory should stand. The decision was signed on 9 December 1988, after the company appealed the recommendation on disturbance compensation. The Irish Transport And General Workers Union said a disturbance payment had been agreed when the workers moved from the Dominic Street factory; the company denied making any commitment. The union had reluctantly accepted the Rights Commissioner’s recommendation as full and final settlement of the workers’ claims arising from the redeployment. The Court considered it a reasonable solution to a genuine difference of recollection that did not prejudice either side’s position on disturbance compensation.
