The Labour Court upheld the Rights Commissioner’s recommendation that a worker’s claim for compensation for lost earnings fail. The decision was signed on 29 June 1988, following an appeal by the Marine Port And General Workers Union against P.D.M. Limited. The worker lost overtime and expenses after a rationalisation programme moved him from driving duties to the Creosote Yard. P.D.M. Limited said he kept his basic rate and continued to earn overtime. The Rights Commissioner found his overtime loss did not match losses experienced by two remaining drivers.
