The Labour Court upheld a Rights Commissioner’s €1,000 compensation recommendation to Samantha Murray after her employer appealed. The decision was dated 18 December 2015.
Ms Murray said she left her job after a colleague bullied her and that her employer failed to investigate her complaints or protect her. The Rights Commissioner upheld her complaint and recommended €1,000 compensation for the loss of her employment. Marinuda Limited T/A Fire & Stone Eatery appealed that recommendation to the Labour Court.
The employer denied that bullying had taken place, describing the conduct as ordinary banter. It said a manager had investigated the complaints and that Ms Murray did not need to resign. After considering both sides’ submissions, the Labour Court upheld the Rights Commissioner’s recommendation.
