The Labour Court overturned a Rights Commissioner’s recommendation and recommended that Kilkenny Borough Council pay a worker the eating-on-site allowance he claimed for 28 September 2011 to 30 May 2012. The decision was signed on 5 December 2014. The worker had received the allowance from May 2012 but sought payment from when it was introduced for outdoor staff. The council said claims normally took effect from the date they were made and disputed his entitlement to earlier payment. The Court found he met the criteria from the allowance’s introduction.
