The Labour Court disallowed a worker’s appeal and upheld a €3,000 compensation recommendation to a worker at Boliden Tara Mines, dated 22 January 2014. The worker, represented by SIPTU, sought compensation for lost earnings after being moved from contractor work back to his original shift. The company said it could reassign him and that he had been told he would work day shifts while assisting the contractor. The Court found the reassignment was within the company’s rights under its agreement with the union. It also found the company had not made clear what payment the worker could claim during the assignment, and upheld the Rights Commissioner’s €3,000 recommendation as fair and reasonable.
