The Labour Court varied a Rights Commissioner’s recommendation on HSE Dublin Mid Leinster’s appeal concerning a retired nurse who had worked in a higher acting-up post for six years. The decision was signed on 19 December 2012. The Court recommended that the terms of any eventual agreement on regularising long-term acting nurses be applied to her as the Rights Commissioner had recommended. The Rights Commissioner’s recommendation used a CNM2 salary level of €53,360 to calculate her retirement lump sum and pension; it was not a cash award. The Court said she should not be disadvantaged by delays in talks because she was not responsible for them and had brought her claim before retiring. The nurse was represented by the Irish Nurses and Midwives Organisation.
