The Labour Court disallowed a worker’s appeal and upheld the recommendation in a dispute with the Services Industrial Professional Technical Union over her request to return to full-time work. The decision was signed on 7 December 2012. The Court agreed that a full-time vacancy in June 2008 should have been advertised, but the worker first applied to return to full-time work in August, after the vacancy arose. She had accepted a policy giving job-sharers no automatic entitlement to a full-time post. The Court found she had not established an entitlement to compensation. She had sought a full-time position and compensation for lost earnings; the union said it followed its work-sharing policy while seeking to reduce staff numbers.
