The Labour Court modified the Rights Commissioner’s recommendation on a worker’s grievance appeal, directing Tesco Ireland to have a staff member from outside the relevant jurisdiction investigate her grievance without delay. It did not recommend compensation. The decision was signed on 2 August 2011. The worker, represented by Mandate, appealed the Rights Commissioner’s recommendation that she and the union agree to use the normal internal procedure. Tesco Ireland said it had offered a grievance hearing and argued that local procedures should resume. The Court said the delay in activating procedures could undermine their effectiveness and employees’ confidence in their impartiality. It directed that the investigation follow the company-union agreement.
