Labour Court sets aside salary-scale recommendation on HSE South appeal

By Fionn Kelly

Labour Court ·

The Labour Court allowed HSE South’s appeal and set aside a recommendation that a worker be placed on point six of the salary scale from May 2004. The Court dated its decision 25 November 2010, finding that HSE South had applied the assimilation agreement in full. The worker, represented by the Independent Workers Union, argued that her private-sector experience entitled her to the top of the scale. She said her current placement left her €7,000 a year worse off; that was her claimed annual loss, not an award. HSE South said it had granted the maximum incremental credit available under the agreement.
