The Labour Court found it had no jurisdiction to hear a worker’s appeal over his grade at retirement. The decision was signed on 16 September 2010; the merits were not decided. The worker, represented by the Services Industrial Professional Technical Union, argued that the dispute arose while he was still employed. HSE Dublin North-East said he referred it after retiring in April 2009. The Court found he referred the matter in July 2009, when he was no longer a worker within the statutory meaning.
