Labour Court overturns pay-scale recommendation on HSE West appeal

The Labour Court upheld HSE West’s appeal and overturned a recommendation that a worker be placed on the Dual-Qualified salary scale from 14 October 2007. The decision was signed on 5 July 2010. HSE West argued that the worker was employed by a private nursing home when the relevant pay circular took effect. The Irish Nurses Organisation argued she had been continuously employed in the health service during the relevant period. The Court found the circular did not apply to the private nursing home and that she was not employed in an HSE position on 1 October 1996, so she did not meet the eligibility criteria.
