The Labour Court upheld a recommendation to withdraw a Dublin City Council truck driver’s final written warning and disallowed the Council’s appeal. The decision was signed on 29 June 2010. The recommendation left the one-week unpaid suspension in place. The Court found the worker culpable for missing work after taking leave without approval. The union, the Services Industrial Professional Technical Union, disputed that he had been told his request was refused and said he believed it had been accepted under the agreed guidelines. The Court considered the Rights Commissioner’s recommendation reasonable in light of mitigation.
