The Labour Court allowed Teagasc’s appeal and set aside a Rights Commissioner’s recommendation that a promotion-related arrangement be extended to a worker. The Court signed its decision on 19 November 2009. The worker, a Grade 2 Advisor redeployed to Teagasc in 1992, was represented by the Irish Municipal, Public and Civil Trade Union. The union said he was among 14 claimants covered by an earlier Labour Court recommendation. Teagasc said his circumstances differed from those of the 13 workers for whom it was implemented, and that the parties had agreed to refer his case separately. The Court found the worker was not part of the group whose transfer circumstances supported the original claim. It said his inclusion was anomalous and found he did not meet the criterion for benefiting from the recommendation.
