The Labour Court overturned a Rights Commissioner’s finding that it had no jurisdiction to hear an unnamed worker’s redundancy claim against Coca Cola Bottlers Ireland, but rejected his claim for enhanced payment. The decision was dated 24 September 2009. The worker disputed how his casual service had been counted in his redundancy calculation and said other employees had their casual service included. The company argued he was not covered by the Industrial Relations Act and said it had treated him fairly by adding six months’ service to its calculation. The Court found he was a worker who had been made redundant and could bring the case. It considered the settlement he accepted under protest a fair compromise and rejected his claim for an enhanced payment.
