The Labour Court increased compensation for a Bord Na Mona worker from €1,000 to €3,000 after upholding the union’s appeal over the handling of his ill-health retirement. The decision was signed on 10 June 2009.
The worker had 41 years’ service. The union argued he was retired without prior discussion or an offer of representation, and that he received information about the medical assessment more than a year later, after the retirement decision had been made. Bord Na Mona said an independent medical assessment and the required approvals left it no option but to proceed. The Court increased the compensation recommended by the Rights Commissioner and varied the recommendation accordingly.
