The Labour Court upheld a recommendation to restore a Waterford City Council worker to a promotion panel and offer him the next available post, dismissing his appeal. The decision was dated 15 October 2008. The general operative, who had 22 years’ experience with the council, declined an acting-up supervisor role because he believed the conditions would reduce his earnings. He was then removed from the panel. Services Industrial Professional Technical Union sought €3,500 for lost earnings and promotion opportunities, arguing another worker had been offered the job on different terms. The council said he declined the role and later accepted a Ganger post in the Roads Department. The Court saw no reason to change the Rights Commissioner’s recommendation.
