In 2007, the Labour Court affirmed a Rights Commissioner’s recommendation in a grading dispute involving Axa Insurance Limited and a worker, subject to modifying its advice about a future Branch Manager vacancy. The Court found the worker’s claim to Branch Manager grading had merit, given the duties of the role and the grading of immediate predecessors. The earlier recommendation gave the worker a 3.5% increment backdated to 23 May 2006 and called for serious consideration for the next suitable Branch Manager vacancy. The Court affirmed the increment recommendation and said the parties should use the company’s existing industrial relations channels and agreements to identify a basis for accommodating the worker with Branch Manager grading. AXA said the role differed from that of a Branch Manager. The decision was dated 19 December 2007.
