The Labour Court recommended discussions about whether a worker at Sligo Dairies Limited could return to his former machine-operator role after he appealed a Rights Commissioner’s recommendation against restoring his former pay differential. In a decision dated 17 December 2007, the Court said restoring the differential would effectively create a fifth grade under the agreed 2005 pay structure. The Court did not recommend reopening the grading negotiations. It recommended that the parties discuss whether the worker could return to his former role if he wished.
